Photography Copyright Policy
"Hardy's Publishing Ltd takes measures to respect the wishes of photographers in relation to their copyright whilst limiting Hardy's Publishing Ltd' liability for infringement. Hardy's Publishing Ltd also helps customers make an informed choice as to which photographers to use."
This Photography Copyright Policy governs the manner in which photographs and other images collected from users (each, a "User") of the https://www.hardysyearbooks.co.uk/ website ("Site") or provided by any other means to Hardy's Publishing Ltd for the creation of printed and/or digital media including yearbooks. Furthermore this photography copyright policy applies to the Site and all other products and services offered by Hardy's Publishing Ltd.
Hardy's Publishing Ltd seeks to ensure that their customers respect the copyright of photos taken by their respective photographers (copyright holders) whilst also limiting Hardy's Publishing Ltd' liability relating to infringement of that copyright.
Photographers make agreements to grant Hardy's Publishing Ltd with a licence to use their photos and in exchange Hardy's Publishing Ltd take the measures detailed in this document to respect photographers' copyright. Where an agreement hasn't been made with a photographer then Hardy's Publishing Ltd will seek to make such an agreement and failing that may refuse to use photos by that photographer within a customers' yearbooks.
To help Clients make an informed choice as to which photographers to use and to quickly communicate a photographer's policy to customers, Hardy's Publishing Ltd makes a list of photographers available to customers which detail the particulars of that photographers' current policy and/or custom agreement(s) with Hardy's Publishing Ltd.
Photographers are encouraged to suggest changes to these measures that we take in regards to our copyright policy and to the copyright policy itself. Please contact John Hardy (managing director) at Hardy's Publishing Ltd directly to discuss such suggestions.
Important copyright notice regarding uploaded photos - please read carefully:
You are providing Hardy's Publishing Ltd with permission to use your uploaded photos in your yearbooks.
You may only upload photos:
- which you have taken yourself (does NOT include scanned photos which you didn't take)
- OR you have received permission to use from the copyright holder (and provided such permission to Hardy's Publishing Ltd
If you wish to upload photos taken by a photographer, you MUST first contact Hardy's Publishing Ltd providing the name of the photographer and a description of the photos.
Please note that:
- owning a photo does not automatically give you a licence to copy/scan/print/use that photo
- photos stored on school databases (e.g. SIMS) do not automatically come with licences to use them
- the copyright of a photo is held by the photographer, and only they can give permission for its use
- if in doubt please contact Hardy's Publishing Ltd or the person/company who took the photos
- not knowing who took a photo does not give you the right to use it
IMPORTANT - We recommend checking with your school photographer - before photos are taken - that they will provide you with a licence to use their photos in your yearbooks and/or similar products without charge or that the appropriate licence fees are agreed in advance.
